These Terms of Use and Sale (“Terms”) govern your access to and use of the Grill Gear website and related services (collectively, the “Services”), including purchases made through our WooCommerce checkout.

The Services are operated by Living Imports Company LLC, a Nevada limited liability company, doing business as Grill Gear (“Grill Gear,” “we,” “us,” or “our”).

By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. Eligibility

You must be at least 18 years old (or the age of majority where you live) to place an order. You represent that you meet these requirements and have the authority to enter into these Terms.

2. Changes to These Terms

We may update these Terms from time to time. Changes are effective when posted and apply to future use and future purchases. The “Last Updated” date indicates the most recent revision.

3. Privacy

Your use of the Services is subject to our Privacy Policy (below). By using the Services, you consent to the collection, use, and sharing of information as described there.

4. Accounts and Security

If you create an account, you agree to:

  • Provide accurate information and keep it updated.
  • Maintain the confidentiality of your login credentials.
  • Notify us promptly of any unauthorized use.

You are responsible for all activity under your account.

5. Orders; Acceptance; Cancellation

5.1 Order Acceptance

Your order is an offer to buy. We may accept, decline, or cancel orders at our discretion, including for suspected fraud, inventory issues, or errors.

An order confirmation email acknowledges receipt, but does not guarantee acceptance. We accept your order when we ship the product(s) or otherwise confirm fulfillment.

5.2 Cancellation Requests

If you need to cancel or change an order, contact us immediately at support@bbqgrillgear.com. We cannot guarantee changes once processing or shipping has started.

6. Pricing; Taxes; Errors

Prices are in USD unless stated otherwise. Taxes and shipping/handling are added at checkout where applicable.

We try to ensure accuracy, but errors can occur (pricing, descriptions, availability). If an error affects your order, we may cancel it and refund you.

7. Payment Processing (WooCommerce)

Payments are processed through third-party payment providers integrated with WooCommerce (e.g., credit card processor, PayPal, etc.). We typically do not store full payment card numbers. Your payment may be subject to the provider’s terms and privacy policies.

You represent that you are authorized to use the payment method provided.

8. Shipping; Delivery; Risk of Loss

Shipping options, costs, and estimated delivery dates are displayed during checkout or described in our Shipping Policy: [insert link].

Delivery dates are estimates and not guaranteed.

Risk of loss and title pass to you upon our delivery of the products to the carrier, to the extent permitted by applicable law.

You are responsible for providing a correct shipping address. Additional fees may apply for returned packages due to incorrect or incomplete addresses.

9. Returns; Refunds; Exchanges

If you do not have a separate Return Policy page, include your key terms here (return window, condition, exclusions, who pays return shipping, etc.). If there is a conflict between a posted Return Policy and these Terms, the Return Policy controls regarding returns and refunds.

10. Promotions; Discount Codes; Gift Cards (If Offered)

Promotions and discount codes may have additional terms (expiration, limits, exclusions) and may be modified or discontinued at any time.

11. Product Use; Safety

Grilling/cooking products may involve heat, fire, sharp edges, electrical components, or other hazards. You are responsible for using products safely and according to instructions, warnings, and applicable laws/codes.

To the fullest extent allowed by law, Grill Gear is not responsible for damages or injuries resulting from misuse, improper installation, unauthorized modification, failure to follow instructions, or unsafe use.

12. User Content (Reviews, Photos, Testimonials)

If you submit content (reviews, photos, videos, comments) (“User Content”), you represent you have the rights to provide it and it does not violate law or third-party rights.

You grant Grill Gear a non-exclusive, worldwide, royalty-free, sublicensable, transferable license to use, reproduce, modify, publish, display, and distribute your User Content for business purposes, including marketing and product pages.

We may remove User Content at any time.

13. Intellectual Property

All content on the Services—including text, graphics, logos, product images, and software—is owned by or licensed to Grill Gear and protected by applicable laws.

You may not copy, reproduce, distribute, create derivative works, scrape, or exploit any portion of the Services without our prior written permission.

14. Prohibited Conduct

You agree not to:

  • Use the Services for unlawful purposes
  • Attempt unauthorized access to systems or accounts
  • Introduce malware or interfere with site operation
  • Scrape, crawl, or use automated means to extract data without permission
  • Post harmful, deceptive, infringing, or abusive content
  • Misuse promotions or attempt to circumvent security

15. Third-Party Links and Tools

Our Services may include links to third-party sites or integrations (including WordPress/WooCommerce plugins). We are not responsible for third-party content, policies, or practices.

16. DISCLAIMERS

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply to you.

17. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, GRILL GEAR WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOST PROFITS, LOST REVENUE, OR DATA LOSS) ARISING FROM OR RELATED TO THE SERVICES OR PRODUCTS.

TO THE FULLEST EXTENT PERMITTED BY LAW, GRILL GEAR’S TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE PRODUCT(S) GIVING RISE TO THE CLAIM IN THE 12 MONTHS BEFORE THE EVENT, OR $100, WHICHEVER IS GREATER.

18. Indemnification

You agree to defend, indemnify, and hold harmless Grill Gear and its affiliates, officers, members/managers, employees, and agents from claims, liabilities, damages, losses, and expenses (including attorneys’ fees) arising out of your use of the Services, your violation of these Terms, or your User Content.

19. Dispute Resolution; Arbitration; Class Action Waiver (Optional)

19.1 Informal Resolution

Before filing a claim, contact us at support@bbqgrillgear.com with details of the dispute and your requested resolution. We will attempt to resolve within 30 days.

19.2 Arbitration

Except for small claims matters, you and Grill Gear agree disputes will be resolved by binding arbitration administered by [AAA or JAMS] under its consumer rules.

19.3 Class Action Waiver

You and Grill Gear agree to bring claims only on an individual basis and not as part of any class, collective, or representative action.

19.4 Opt-Out

You may opt out of arbitration within 30 days of first accepting these Terms by emailing support@bbqgrillgear.com with your name and a clear opt-out statement.

20. Governing Law; Venue (Nevada)

These Terms are governed by the laws of the State of Nevada, without regard to conflict of law principles.

If arbitration does not apply, you agree that any dispute will be brought in the state or federal courts located in Clark County, Nevada and you consent to jurisdiction and venue there.

21. Termination

We may suspend or terminate access to the Services if we believe you violated these Terms or used the Services unlawfully.

22. Miscellaneous

  • Severability: If any part is unenforceable, the rest remains in effect.
  • No Waiver: Failure to enforce a right is not a waiver.
  • Assignment: You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or asset sale.
  • Entire Agreement: These Terms and referenced policies form the entire agreement regarding the Services.
